1. Acceptance of Terms

By accessing and using the Shaam e Awadh website and services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms & Conditions, please do not use our services.

2. Eligibility

You must be at least 18 years old to use our services. By using our website, you represent and warrant that you are of legal age to form a binding contract and meet all eligibility requirements.

3. Account Registration

Placing an order through the website requires an account, verified by a one-time password sent to your email address. You may also place an order directly over WhatsApp without registering. If you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as necessary
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

4. Products and Pricing

We strive to provide accurate product descriptions and images. However:

• We reserve the right to correct any errors, inaccuracies, or omissions
• All prices are subject to change without notice
• Prices are displayed in Indian Rupees (₹)
• Product availability is subject to change
• We reserve the right to limit quantities or refuse orders

5. Orders and Payment

When you place an order:

• You agree to pay the price listed for the products and delivery charges
• We accept UPI, and "Pay After Eating" — no upfront payment, settled after delivery
• UPI payments are verified manually; we may contact you on WhatsApp to confirm a transaction
• Orders are confirmed over WhatsApp and are not binding on us until we confirm them
• Orders are subject to acceptance and availability
• We reserve the right to cancel orders at our discretion
• In case of cancellation, refunds will be processed according to our refund policy

6. Delivery

Delivery terms:

• We deliver only within Greater Noida West and Noida Extension. Serviceable pincodes are: 201009, 201307, 201318, 201306, 201301
• We aim to deliver within the hour, but delivery times are estimates only
• A delivery charge of ₹50 applies to orders of ₹500 or less
• Delivery is free on orders above ₹500
• You must provide an accurate delivery address and a reachable phone number
• We are not responsible for delays due to incorrect address or recipient unavailability
• Risk of loss passes to you upon delivery

7. Returns and Refunds

Due to the perishable nature of our products:

• Returns are generally not accepted for quality reasons unless the product is defective or damaged
• If you receive a damaged or incorrect product, contact us within one hour of delivery
• For "Pay After Eating" orders no payment is taken upfront, so a refund does not arise — raise the issue with us before settling
• For UPI orders, approved refunds are returned to the UPI account you paid from, normally within 2-3 business days
• We reserve the right to request proof of defect

8. Quality and Food Safety

We are committed to providing fresh, high-quality products. However, we recommend that you:

• Inspect products upon delivery
• Store products properly according to food safety guidelines
• Consume products before their expiration date
• Follow proper cooking and handling procedures

We are not liable for any illness or injury resulting from improper storage, handling, or cooking of products.

9. Prohibited Uses

You agree not to:

• Use our services for any illegal purpose
• Violate any applicable laws or regulations
• Infringe upon intellectual property rights
• Transmit viruses or malicious code
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt our services
• Use automated systems to access our website without permission

10. Limitation of Liability

To the maximum extent permitted by law, Shaam e Awadh shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services.

11. Indemnification

You agree to indemnify, defend, and hold harmless Shaam e Awadh and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of our services or violation of these Terms & Conditions.

12. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Shaam e Awadh or its content suppliers and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

13. Modifications to Terms

We reserve the right to modify these Terms & Conditions at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after changes constitutes acceptance of the modified terms.

14. Termination

We may terminate or suspend your account and access to our services immediately, without prior notice, for any breach of these Terms & Conditions or for any other reason we deem necessary.

15. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in India.
